1. Scope and statutory rights

These terms apply to the additional commercial warranty for vintage and pre-owned watches sold by Yellow Seconds to consumers. The warranty covers the watch identified on the proof of purchase.

This warranty does not limit your statutory rights. If the watch does not conform to the contract, you are entitled to repair or replacement by Yellow Seconds free of charge and, where the legal requirements are met, a price reduction or termination of the contract with a refund. These rights may continue after the warranty period stated below has expired.

The limitations and exclusions below apply solely to this additional warranty.

2. Duration and coverage

Yellow Seconds provides a twelve-month warranty from the day you receive the watch.

This warranty covers internal movement defects that cause the watch to stop unexpectedly or cease running during normal use. The defect must become apparent within the warranty period. For this additional coverage, you do not need to establish that the cause was already present at delivery.

Normal use means wearing and operating the watch with care in accordance with the supplied instructions, taking its type and age into account. A mechanical watch must be wound sufficiently or, where applicable, worn sufficiently.

A watch stopping solely because its available power reserve has been exhausted or its battery has run down through normal use is not a movement defect covered by this warranty.

3. Accuracy and other components

This additional warranty makes no promise concerning a specific daily rate deviation, chronometer standard or original factory tolerance. A timekeeping deviation alone does not give rise to a claim under this warranty.

This does not affect specific promises made at the time of sale or your statutory right to a watch that conforms to the contract.

This warranty does not cover cosmetic restoration, routine servicing in the absence of a covered movement defect, or standalone repairs to external components such as the case, crystal, crown, pushers, bezel, dial, hands, strap, bracelet and clasp. Work on such components that is necessary to remedy a covered movement defect is included in the repair free of charge.

4. Water, damage and third-party intervention

Yellow Seconds does not warrant waterproofness or water resistance under this additional warranty. Treat the watch as not water-resistant: avoid contact with water and do not wear it while showering, swimming or diving. Original manufacturer specifications or markings on the watch do not, by themselves, constitute a current promise by Yellow Seconds concerning water resistance.

This additional warranty does not cover defects or damage to the extent caused or worsened by:

  • drops, impacts, accidents or careless use;

  • water, moisture or dirt entering the watch through external exposure after delivery;

  • incorrect operation or use contrary to the supplied instructions;

  • opening, repair, modification or other intervention by you or a third party without prior permission from Yellow Seconds.

You should therefore have Yellow Seconds assess the watch first if you suspect a defect. The mere fact that a watch has been dropped or opened by a third party does not automatically invalidate claims relating to an unrelated defect. Statutory rights remain applicable.

5. Reporting a defect and arranging inspection

Report a suspected defect as soon as reasonably possible using the email address above. Include your name, purchase details, a description of the problem and when it first occurred. A report made within two months of discovery is always considered timely. A defect arising within the warranty period may also be reported after the warranty expires, provided it is reported within this notification period.

Give Yellow Seconds a reasonable opportunity to inspect the watch and repair a covered defect. We may appoint a qualified watchmaker to carry out the inspection and repair. You must make the watch available for this purpose. We will agree with you in advance how the watch should be safely delivered or shipped.

If you suspect a defect, stop using the watch where continued use could worsen the damage. Contact us immediately if moisture enters the watch.

We will share the inspection findings with you. If we reject the claim, we will explain in writing the findings and exclusion on which the rejection is based. Our assessment does not affect your right to dispute the outcome. The statutory rules on the burden of proof continue to apply.

6. Repairs and costs

For a covered defect, Yellow Seconds will arrange repair free of charge within a reasonable time and without significant inconvenience. This includes necessary parts, labour, inspection and necessary transport. We will inform you of the expected turnaround time.

If repair is impossible or cannot be completed within a reasonable time, we will offer an appropriate solution: replacement with an equivalent watch agreed with you, or a refund of the purchase price upon return of the watch. Your statutory rights remain fully applicable.

If the problem falls outside both this warranty and your statutory rights, we will offer a paid solution where possible. We will charge inspection, transport or repair costs only if you have been informed of the amount or calculation method and have expressly agreed before those costs are incurred.

Under this additional warranty, costs incurred by third parties engaged by you will only be reimbursed with our prior permission. Any statutory right to reimbursement remains unaffected.

7. Governing law and language

This warranty is governed by Dutch law. This choice of law does not deprive consumers of the protection of mandatory legal provisions that would apply in the absence of this choice.
